1. Acceptance of Terms
By accessing or using DiamondEdge ("the Service") you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
DiamondEdge is a sports analysis subscription service that provides statistical modeling and data-driven commentary on Major League Baseball games. The Service is for entertainment and informational purposes only and does not constitute betting or gambling advice.
3. Subscriptions and Payments
Paid access is offered as a Day Pass (one-time payment), Monthly subscription, or Yearly subscription. Subscriptions renew automatically unless cancelled. You may cancel at any time through your account settings. Refunds are not provided for partial billing periods.
4. Prohibited Use
You may not resell, redistribute, or share your account or any paid content with others. Automated access, scraping, or reverse engineering of the Service is prohibited.
5. Limitation of Liability
DiamondEdge is provided "as is." We make no guarantees as to the accuracy or usefulness of our analysis. To the maximum extent permitted by law, DiamondEdge shall not be liable for any direct, indirect, or consequential damages arising from your use of the Service.
6. Termination
We reserve the right to suspend or terminate your account and access to the Service, with or without notice, if you violate these Terms (including the prohibited uses in Section 4) or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately. Sections relating to limitation of liability, governing law, and dispute resolution survive any termination.
7. Governing Law and Jurisdiction
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Maine, United States, without regard to its conflict-of-laws principles. Subject to Section 8, you agree that the exclusive venue for any dispute not subject to arbitration shall be the state or federal courts located in Maine, and you consent to the personal jurisdiction of those courts.
8. Dispute Resolution
Before filing any claim, you agree to first contact us at contact@baseballpredictions.net and attempt to resolve the dispute informally. Any dispute that cannot be resolved within 30 days shall be resolved by binding individual arbitration administered in the State of Maine under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. To the maximum extent permitted by law, disputes must be brought on an individual basis only, and you and DiamondEdge waive any right to participate in a class, collective, or representative action.
9. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
